High bail for teen drug, gun suspects

ATTLEBORO - A judge ordered two accused teenage drug dealers held in jail on high bail Thursday, but denied a prosecutor's request to hold them without bail under the state's dangerousness law.

Ryan McCoy, 19, of 115 Hedley Ave. in Central Falls, R.I., and Rithana Pho, 17, of 4 Eden Terrace in Attleboro, each were ordered held in jail on $50,000 cash bail by Attleboro District Court Judge Gregory L. Phillips.

The pair was arrested April 8 after a routine traffic stop by Attleboro police around 3:30 a.m. on Pleasant Street near Starkey Avenue, according to testimony.

Police say they recovered a loaded .22-caliber semi-automatic handgun from a locked glove box and three rounds of hollow-tipped .22-caliber ammunition.

They also said they recovered about 10 plastic bags containing small amounts of marijuana and cocaine and $1,236 cash.

McCoy, who was the driver, was also found with Percocet pills, police said.

The teenagers have pleaded innocent to possession of cocaine with intent to distribute, possession of marijuana and weapons charges. McCoy faces an additional drug charge related to the pills.

Prosecutor Brian Carney wanted the two suspects held without bail, contending they were dangers to the public. He argued they were riding around in a car with a loaded gun and drugs packaged for sale and now face serious felony charges.

Bristol County District Attorney Sam Sutter's office has a policy of requesting dangerousness hearings in such cases.

Nicolas A. Gordon, the lawyer for McCoy, argued that prosecutors failed to show the two suspects were a danger to society.

Gordon argued that his client was driving his grandfather's car and had no access to the glove box. He argued no key was found in the car.

But Carney argued that McCoy's court papers were found inside the glove box after it was forced open by police.

Paul Carlucci, the lawyer for Pho, argued his client was merely a passenger in the vehicle. He said his client faces a previous assault charge, but has not been convicted of any crime.

McCoy also has a pending assault charge but Gordon said he expected the case to be dismissed. The suspects are due back in court June 4 for pretrial motions.
