ATTLEBORO - A 20-year-old Mansfield man was sentenced to four years in jail Wednesday after a jury convicted him of indecently touching a 17-year-old girl last summer.

Jose Salva, of 24 Bicentennial Court in Mansfield, was also acquitted of indecently touching another 17-year-old girl while all were in the same Mansfield apartment.

Salva's lawyer, Edward Sullivan of Attleboro, suggested in his closing argument after the two-day trial in Attleboro District Court that the incidents on June 22, 2007 were consensual.

Salva's girlfriend at the time, who was friends with the girls, contradicted testimony by the other two girls.

The jury also got to view a 30-minute police videotape in which Salva told Mansfield Detective Frank Archer that one of the girls "came on" to him and performed a sex act on him when he entered a room in the apartment. During her closing argument, Assistant District Attorney Jennifer Thompson referred to testimony by the girls.

"Ladies and gentleman of the jury, we've all heard the saying, 'No means no.' Apparently Jose Salva did not want to hear that," Thompson said.

Salva did not testify in his own defense.

After about an hour of deliberation, the jury found Salva guilty of two counts of indecent assault and battery and innocent of two other counts.

Judge Richard Savignano gave Salva two consecutive maximum 2 1/2-year jail terms. On the second count, he ordered Salva to serve 18 months and suspended the one-year balance of the term for three years with probation.

Upon his release from jail, Salva will be monitored by a Global Positioning Satellite system while on probation, must register as a sex offender and stay away from the victim.
