D-Day for area dog park?




FOXBORO - Selectmen and the conservation commission will tackle dog park legal issues Tuesday night.

They'll have an audience.

Selectmen scheduled the 7:20 p.m. meeting in the auditorium of Foxboro High School.

A central question is whether the town wants to postpone an Aug. 6 trial in Boston Land Court and form a committee to find a new location for a dog park.

Selectmen and the plaintiffs, through their lawyer, have exchanged proposals aimed at settling the legal dispute. The commission, which manages the land, voted unanimously late last month to support going to trial, an action that could clarify whether a dog park is a legal use of the town conservation land at Cocasset River Park.

Both boards are the defendants in a suit filed in Land Court last February by abutters and other seeking to close the park.

A related question is whether Town Manager Andrew Gala has the authority to close the park.

Selectmen voted 3-2 last week to put on their Tuesday agenda the counteroffer written by attorney Edward Valanzola on behalf of the plaintiffs.

That offer is expected to be a central part of the discussion.

How do you equate someone not believing a dog park is an allowed use to someone being a "dog hater"? 2.5 children - no, I can't imagine someone having 2.5 children either! I highly doubt anyone is looking at the town saying "they're dog haters" unless they're similarly looking at every other town without a dog park as "they're dog haters". "

Fox Res - Let me repeat it AGAIN... NO MONEY was spent by the town until the abutters filed suit. Now the town is looking to move the park. WHO is going to pay for that? AND SO WHAT if out of towners use the park? Can anyone say revenue? They pass through and stop at a store or two. Maybe Husband takes Rover to the park while Wife shops at Patriot place for the afternoon. Foxboro is one of the best dog parks around. Let's flaunt it and promote it as the Gem of Norfolk County dog parks. We do have a bunch of houses that need selling. I can't imagine a couple with 2.5 children discussing Foxboro and saying, "Oh no, it's got a dog park.. Lets not move there!" It could be a positive if the stubborn neighbors would just COMPROMISE. There is a word for you Selectman Mortensen. Now we just look like a town full of dog haters. Of course the land will be left for the abutters backyard. If you don't believe that your as clueless as our Selectmen.
And to our newest selectman: Youre supposed to represent the ENTIRE town, not just the abutters. "

" Have the abutters said to you that they want to use Cocasset River Park as their backyard? The only thing I've heard is that the plaintiffs oppose the dark park being there and don't believe it is a use allowed under law.

There are rules the commission must adhere to (town, state, federal) as well; they can not just do with the land "as they pleased and saw fit."

There have been others who have cleaned up the park and others who volunteered to do more, maybe you missed them or don't live in town so don't know that.

Are all the abutters using the same language? Are you sure no one has been using similar language towards the abutters while you were not present?

It is costing the town and residents money in more than a few ways. "

I never said that it was an end all- I just think that the abutters want the land now being used as a dog park as an extension of their back yard.

The land was donated to the conservation commission to do with as they pleased and saw fit.
Here I was going to say the same things I have said numerous times before- so I wont say it again.

No one has been yelling at or cussing out the abutters- yet 'they' are now back to the beginning- yelling at us as we use the park and cussing- using the F word when children are present- and yes I was there during this time.

Everything is going to take time- the dog park is not draining any funds from the town- Debbie and Heather raised the money to support the clean-up, the fences and got sponsors for the waste removal- not costing the town one dime until the abutters decided they didn't want the park there. Why did they not speak up when the town was considering allowing the park and doing everything they needed to do to get it approved??? "

Since there are at least three other areas identified as places to locate a dog park - why not vote to move it and be done with the issue?

KyraSkye - How the judge rules might not be the end-all some expect. Are you suggesting someone in our town is being paid to do or say something?

Supposedly someone from the town attorney's office is able to be present; if it's a law firm, that shouldn't be or cause a problem. Let's not forget that a few legal eagles repesenting the town gave multiple opinions on things (see newspapers) and according to the newspaper someone representing the town on a paid legal basis already slandered people not wanting a dog park there by calling them dog park haters. At this point, think it doesn't matter what opinion the town's legal counsel gives.

All those issues have been slow going as well. Sewering the town has been an issue since ~70's, selling the fire station and Oak St., and the roads have been on the 'todo-list' for a while too. Not sure why you say they have no back bone; they're actually showing it now. "

Also it's being held in the auditorium due to the number of people who are expected to show up.

This is going to show that people with money do always get what they want when they throw enough of it around. If we were in NW Florida you would know that pockets were being padded. "

" Why bother having a meeting-- we know we have a bunch of weak knee selectmen with no back bone. Oh and where will the towns attorney be when this going on? I hear not invited (oh I forgot Thrasher with his new partner will represent us--you know Paul--I am for compromise). I say let the judge decide and be done with it.

Spend some time Tueday on the issues that have been forgotten like funding sewers, selling the fire station, selling the Oak Street land, remodeling town hall, getting the roads fixed, getting the dam fixed, filling vacant board seats and much more.

Maybe they shoud actually meet in open session and do something beyond worrying about some dogs and unamed union contracts which is normaly how the handle going into exec sessions --just they word contract - no need to which one-- we can find that out in a few years when they are long gone and someone else releases the minutes.

Will this be on Cable 22? It is at the High School rather than the normal venue? "
